VACATION RENTAL AGREEMENT
PLEASE ENSURE ALL INFORMATION IS CORRECT AND SIGN THE AGREEMENT.
THIS RENTAL AGREEMENT IS BINDING ON ALL GUESTS AND PERSONS
OCCUPYING OR VISITING PROPERTY.

1. AGREEMENT Summit Mountain Properties, the Owner, and Guest agree as follows: Above
Guest is an adult over the age of 25 and will be an occupant of the unit during the entire reserved
period. Other occupants will be family members, friends or responsible adults. Use of the
premises will be denied to persons not falling within the foregoing categories, and as a result
they would have to vacate the property immediately without any refund. No keys will be issued
to anyone who is not an adult over 25 years of age. Unless approved no events, parties, or
weddings may take place on the property at any time.
2. DAMAGE: Your reservation includes a damage waiver, the damage waiver covers any
accidental damages up to $1,000 during your stay, provided guest notifies Summit Mountain
Properties immediately of any damages. Any damage that occurs during your stay that does not

fall into this category will be charged to your credit card. The damage waiver is non-
refundable. Check in instructions will be sent only after the damage waiver has been paid. Any

damages, losses or excessive cleaning charges incurred by you or your group not reported
immediately will be charged to your credit card. Guest agrees to pay Summit Mountain
Properties for the total rental price and/or to reimburse Summit Mountain Properties for damages
and costs incurred to repair/replace damaged items. I understand that by signing below, I am also
accepting liability for any damages caused to the property, unpaid rental fees or excessive
cleaning fees (other than normal use) by myself, or my family and/or guests, including, but not
limited to, landscaping, misuse of appliances, and/or equipment furnished. Please report
immediately any accidents and or incidents that cause damage to the house, furnishings,
decorations, or household amenities that occur during your stay. The property is located in an
alpine environment and garage doors, exterior doors and windows must be kept closed at secured
at all times. Failure to do so may result in frozen pipes and additional plumbing and or flood
repairs which will be charged to the reservation credit card on file. Unreported damages
discovered after check out will incur a $100 fee in addition to the repair / replacement cost. This
policy is in place to allow us to remedy the situation immediately and avoid unnecessary
inconveniences to the next tenants. Summit Mountain Properties reserves the right at any time
during your occupancy to enter the unit for necessary inspection and or maintenance repairs.
3. PAYMENT: The signer of this document agrees to pay Summit Mountain Properties the full
rental price of {reservations.price_total}. A 50% deposit is required for reservation, and the total
rental price must be paid in full by at least 60 days prior to check-in. By signing this document,

you alone agree to accept full responsibility for full payment of your reservation.

4. PETS: Unless otherwise stated, we do not allow pets at any of the properties. If an un-
authorized dog is found to have been in the unit a minimum $250 cleaning charge will be

charged to your credit card, plus any additional damage that was caused by the dog. This
includes: scratches to floor, carpet requiring cleaning, dog smell that must be removed, etc. WE
WILL FIND OUT IF YOU HAVE AN UNAUTHORIZED DOG IN THE UNIT AND YOU
WILL BE CHARGED.
5. CANCELATION: Due to the nature of the vacation rental business, we cannot accept
cancelations after 60 days prior to check in, you will forfeit all sums paid. Cancelations 61 days
or more prior to arrival for non-holiday timeframes are refundable less a 5% cancelation fee. If a
cancelation occurs within 60 days of arrival, no refund will be issued and all funds are forfeited,
if cancelation occurs within 90 days of a holiday rate arrival no refund will be issued and all
funds are forfeited. Holiday dates are subject to a 90 day cancelation policy, we do not refund for
cancelations made 90 days or less prior to arrival for reservations during the dates of: December
19 – Jan 4.
If a cancelation occurs before 60 days of arrival or 90 days of arrival for holiday dates the
deposit paid will be refunded less a 5% cancelation fee. We can not offer refunds due to weather

6. CHECK IN: Check in time is 4:00 PM. EARLY CHECK IN TIMES ARE ALLOWED ONLY
WHEN THE PROPERTY IS CLEANED AND READY FOR OCCUPANCY AND PRIOR
APPROVAL IS REQUIRED. Please contact Summit Mountain Properties no more than 3 days
prior to arrival to request an early check in, we are unable to confirm early arrivals earlier than 3
days before your arrival date. There will be a $100 per hour charge for any unapproved early
arrivals. Keys will be found in the lockbox at the property location, guests will be provided
check-in information via e-mail 7 days prior to arrival. The lockbox combination will not be
issued with a balance owing or without a signed rental agreement in Summit Mountain
Properties possession.
7. CHECK OUT: Check out time is 10:00 AM, PRIOR APPROVAL IS NEEDED FOR LATE
CHECK OUT. There will be a $100 per hour charge for any unapproved late check outs. Please
contact Summit Mountain Properties no more than 3 days prior to your check out date to request
a late check out, we are unable to confirm late departures earlier than 3 days before your
departure date. Please leave all keys, remote controls, and garage door openers (if issued) at the
location. A replacement fee will be charged for each lost key, remote control, or garage door
opener.
8. CLEANING: Each property will be inspected and cleaned after your departure. The rental fee
you have paid will provide for a full cleaning so that you can enjoy your vacation up to the last
moment. YOU ARE REQUIRED to leave the property in the same general condition in which it
was received. We would also appreciate it if you would make sure that dishes are placed in the
dishwasher and the home is generally picked up and ready to be vacuumed and dusted. ALL
PROPERTIES ARE NON-SMOKING. Smoking in the properties will result in an additional
minimum $250 charge to the credit card on file or will be deducted from your security deposit. If

you smoke outside of the property you must pick up and properly dispose of all cigarette butts.
There will be a minimum $100 charge if any cigarette butts are found anywhere on the exterior
of the property.
9. TELEPHONES: YOU MUST USE CREDIT CARDS OR CALL COLLECT WHEN
MAKING LONG DISTANCE TELEPHONE CALLS. There is no charge for local calls. Not all
properties have a land line available and a cell phone is recommended.
10. WHAT WE SUPPLY: The property is equipped and set up as a fully furnished property that
will include linens, blankets, pillows, towels, as well as a fully equipped kitchen, TVs,
furnishings. The house will have a starter supply of dish soap, dish detergent, toilet paper, paper
towels, laundry detergent, trash bags, and bar soap. Once you run out of the starter supply you
will be responsible for providing and purchasing these items, which are available at the local
grocery stores. Although we made every effort to anticipate most people's needs, we may not
have all the items you would be accustomed to at home. Please note we do not stock saran wrap,
foil, spices, salt, pepper, etc. Many times previous guests will leave these items and the property
will have a supply however it may not be provided so please plan accordingly. Please be aware
you are renting a private home, this is not a resort or a hotel and you may be required to purchase
and or bring along necessary items. If the property you are renting has a BBQ grill you will need
to provide necessary propane, which may be found at any of the local stores.
11. SLEEPING CAPACITY/DISTURBANCES: Guests and all other occupants will be required
to vacate the premises and forfeit the rental fee and security deposit for any of the following: A.
Occupancy exceeding the sleeping capacity stated on this rental agreement. B. Using the
premises for any illegal activity including, but not limited to, the possession, serving or
consumption of alcoholic beverages by or to persons less than 21 years of age. C. Causing
damage to the premises rented or to any of the neighboring properties. D. Any other acts which
interferes with neighbors' right to quiet enjoyment of their property. E. Any party, reception,
dinner, wedding, or any unauthorized event in which the number of persons at the property
exceed the stated occupancy capacity of the property on this rental agreement. Unauthorized
events are not allowed and you will forfeit your damage deposit if an unauthorized event takes
place at the property. IF, FOR ANY REASON, LAW ENFORCEMENT IS NOTIFIED DUE TO
DISTURBANCES EMANATING FROM THE PREMISES OR GROUNDS, THERE WILL BE
A MINIMUM $250 CHARGE TO YOUR DAMAGE DEPOSIT PER INCIDENT. You must
obey the maximum number of vehicles allowed on the property at any time, and no parking is
allowed on the street at anytime. YOU WILL BE TOWED IF YOU PARK ON THE STREET
OR HAVE VEHICLES EXCEEDING THE STATED CAPACITY. No events are allowed such
as weddings, parties, receptions, dinners, etc without prior written approval from Summit
Mountain Properties and an additional event fee of at least one nights rent and an additional
event contract may be required if the event is authorized. Pond Hockey Tournament groups are
not allowed.
12. HOLD HARMLESS: Summit Mountain Properties, Inc does not assume any liability for
loss, damage or injury to persons or their personal property. Neither do we accept liability for
any inconvenience arising from any temporary defects in appliances or any amenity, stoppage in
supply of water, gas, electricity, or plumbing. Nor will Summit Mountain Properties accept
liability for any loss or damage caused by weather conditions, lack of snow, natural disasters,

acts of God, or other reasons beyond its control. Refunds will not be issued for any of the
aforementioned items. Summit Mountain Properties reserves the right to substitute properties. In
the event the property reserved becomes uninhabitable or unavailable Summit Mountain
Properties may substitute a property of similar value.
13. HOT TUB & PATIOS: Guest hereby acknowledges that if the property they have reserved
includes a hot tub, the undersigned is fully aware that the hot tub and surrounding patio/deck can
be dangerous, that the deck/patio can be slippery when wet, and that injury is likely to occur to
anyone who is not careful. Guests should observe and adhere to all rules and policies as posted at
the property. With full knowledge of the above facts and warnings, the undersigned accepts and
assumes all risks involved in or related to the use of the hot tub and patio areas. The Guest is
responsible for any damage to hot tub or water, including dirty water and debris in or around the
tub as a result of your usage. If tub requires a drain as a result of Guest usage, a minimum $150
charge will be deducted for your Damage Deposit. Summit Mountain Properties reserves the
right to compensation for any damage or excessive cleaning charges caused by you or any
member of your group.
14. ADDITIONAL TERMS AND CONDITIONS: The undersigned, for himself/herself, his/her
heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and
all claims, demands and causes of action by reason of any injury or whatever nature which has or
have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in
connection with the occupancy of the premises and agrees to hold Owner free and harmless of
any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the
parties to this agreement, their principals, agents, successors or assignees the prevailing party
shall be entitled to recover reasonable attorney fees and costs. While we strive to ensure the
equipment in all of our properties is in good working condition, sometimes things do break. We
do our best to correct problems in a timely manner. No refunds or rate adjustments are made
for mechanical failures. This includes hot tubs, fireplaces, appliances, as well as Internet,
TV or cable outages. We also reserve the right to make any necessary property moves due to
mechanical failures.
15. PAYMENT BY CHECK: If the Guest pays by check rather then credit card, and the check is
returned for NSF there will be a $50 service charge. Keys will not be issued until the check has
successfully cleared the bank. Checks should be made payable to Summit Mountain Properties.

I AM AWARE THAT I AM RENTING A PRIVATE HOME. I WILL TREAT IT WITH
THE SAME RESPECT I WOULD EXPECT TO BE SHOWN TO MY OWN HOME. I
agree to allow Summit Mountain Properties to charge my credit card as indicated above for the
full rental amount, the full security deposit amount, and any additional damages and excessive
cleaning fees that incur as a result of me or my party. Receipt of this rental agreement does not
guarantee a reservation or a hold on your requested dates. A reservation is only confirmed after a
signed rental agreement has been returned and a deposit paid.
